General terms of use

 

These general terms and conditions govern the relations between "MIVAVIS" LTD regarding the services provided by Midalidare Hotel & SPA and the hotel's clients.

 

TERMS AND CONDITIONS FOR RESERVATION

1.1. You can make a reservation at "Midalidare Hotel & SPA" in one of the following ways:

·        Through the official website www.hotel.midalidare.bg, through the integrated reservation module;

·        Through the booking.com website;

·        On site at the hotel.

1.2. Upon requesting and paying for a reservation through the reservation module, you will receive a confirmation e-mail to the address you provided, with a description of the type and number of rooms reserved, date and time of check-in and check-out from the hotel, number of adults and children, as well as other information specified in the reservation request.

1.3. With the requested and confirmed reservation at Midalidare Hotel & SPA, the client enters into contractual relations with "MIVAVIS" LTD and accepts these general terms and conditions.

1.4. All reservations and accommodations at Midalidare Hotel & SPA are made in accordance with the terms of the requested and confirmed reservation request, which terms are part of the contract concluded between the parties.

 

TERMS OF CANCELLATION A RESERVATION

2.1. You can cancel a reservation in one of the following ways:

·        Through the official website www.hotel.midalidare.bg, through the integrated reservation module;

·        by phone + 359 886 65 57 21.

2.2. When canceling a confirmed reservation (not valid for package and holiday offers) within 3 (three) days before the date of accommodation, the client does not owe a penalty. 

2.3. If you cancel a confirmed reservation (not valid for package and holiday offers) within 3 (three) days before the check-in date or in case of no-show on the day of check-in, you will lose the amount paid.

2.4. If you cancel a confirmed reservation for holiday and package offers within 10 (ten) days before the check-in date, the amount paid in advance for your reservation will be refunded, and the reservation will be considered canceled. If you cancel within a shorter period of time or in case of no-show on the day of check-in, you will lose the amount paid.

2.5. Individual contracts are drawn up for holding weddings and conferences.

 

ACCOMMODATION CONDITIONS

3.1. Check-in is carried out in accordance with the conditions and times specified in the requested and confirmed reservation request.

Reservations are held until 24:00 on the relevant day of arrival

3.2. Rooms are vacated by 12:00, unless another time has been agreed between the parties.

In case of later vacating the room, a penalty is due, as follows:

·        In case of delay, a penalty of 50% of the cost of the night is due.

·        in case of late payment after 18:00, a payment of 100 (one hundred)% of the cost of the night is due.

3.3. Children under 5 years of age are accommodated free of charge.

3.4. Pets are not allowed.

3.5. Smoking is prohibited in all internal parts of Midalidare Hotel & SPA. In case of violation of the ban in the "Vintage" restaurant, "Open Air" restaurant, the premises in Midalidare Hotel & SPA, Midalidare Gastro Pub, Guest House on the territory of the hotel, the guest pays a penalty of 500.00 BGN. In case of violation of the ban in the Midalidare Gastro Pub restaurant and "Estate" House, the penalty is 1000.00 BGN.

3.6. Check-in at the hotel is by presenting personal documents certifying the identity of the clients. The data provided by the client are protected, in accordance with the Data Protection Act and Regulation (EU) 2016/679, and are processed only in connection with the purpose of this contract.

 

ACCOMMODATION PRICES

4.1. The prices for accommodation at "Midalidare Hotel & SPA" are indicated on the website http://hotel.midalidare.bg/.

4.2. The prices on the hotel website - http://hotel.midalidare.bg/, as well as in e-mail correspondence are in Bulgarian leva, including VAT and tourist tax.

 

PAYMENT METHODS

5.1. In cash or debit/credit card, when requesting a reservation at the hotel.

5.2. Bank transfer to the provided bank account

 

RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. Midalidare Hotel & SPA undertakes to provide the hotel guests with the services requested and paid for in full.

6.2. Midalidare Hotel & SPA undertakes not to change the price of the paid services for confirmed and paid reservations.

6.3. The costs for additional services may be included in the reservation price or paid additionally.

6.4. Amounts for services requested but not used in whole or in part due to the fault of the hotel guests are not refundable.

6.5. Midalidare Hotel & SPA provides its guests with a daily service from 10:00 a.m. to 2:00 p.m. It is optional, i.e. if the guest does not wish to use the service, he can place a "Do Not Disturb" information sign on the door.

6.6. Hotel guests are obliged to observe generally accepted standards of good behavior during their stay at the hotel and to maintain and preserve public order. Hotel guests are responsible for all damage caused as a result of damaged and/or missing property on the furniture or equipment in the premises used by them, property of the hotel facilities, caused during their stay. All costs for material damage to the hotel are paid by the persons who caused them at market prices, after providing an invoice.

6.7. In case of lost/forgotten items found by the guests, they should contact Midalidare Hotel & SPA by email or phone as soon as possible and notify the staff of the loss, with a description of each of the items: type, brand, size, color and other individualizing features, as well as a description of any relevant facts and circumstances. The hotel staff will assist the guests in the presence of forgotten items in the Midalidare & Spa hotel.

6.8. The hotel is not responsible for lost, forgotten or stolen items from the rooms, restaurants or pool, as well as for damage caused by third parties.

6.9. The hotel is not responsible for damage caused to the guests caused by the actions of third parties.

6.10. Hotel guests are obliged not to leave their children unattended on the hotel premises. The hotel is not responsible for persons under 18 years of age left unattended.

6.11. The parking lots next to the Midalidare & Spa Hotel are not physically guarded and the hotel is not responsible for damage caused to vehicles. Guests are informed that the Midalidare & Spa Hotel is implementing video surveillance of the parking lots next to its hotel part, in order to ensure the safety and security of the hotel guests within 24 hours.

 

COMPLAINTS

All complaints related to the quality of the paid services should be filed on site at the hotel with a detailed written description of the discrepancy between the agreed and the provided services and, if available, provide proof. The advertised services are paid for before leaving the hotel and the restaurant. The manager of the Midalidare Hotel & Spa shall arrange an inspection of the received claim and within seven days shall respond to the guest/by email/ as to whether he accepts the claim and/or in what part, as of its receipt. In case of acceptance of all or part of the claim, the guest shall be transferred the undue amount determined by the manager to the guest's bank account.

 

GENERAL TERMS AND CONDITIONS FOR SALE AND RESERVATION OF VOUCHERS

1. Definitions

1.1. Midalidare website: Midalidare Hotel & SPA sells gift vouchers on site at Midalidare Hotel & SPA, by phone - 0886 65 57 21 or by e-mail: reservations.hotel@midalidare.bg

1.2. We, Midalidare Hotel & SPA: Midalidare Hotel and Spa, village of Mogilovo, municipality of Chirpan.

1.3. You, Client, User: Means a person using the services and offers of Midalidare Hotel & SPA.

1.4. Gift voucher, voucher, service: Midalidare Hotel & Spa sells services and hotel products through vouchers, with all products and services being sold at the hotel. The purchased tourist service cannot be resold to third parties according to Art. 87A of the Bulgarian VAT Act.

 

2. Prices

2.1. All prices of products on the site are in Bulgarian leva and in euros, depending on the choice of the user, for one item, with VAT and do not include delivery costs. 

3. Validity

3.1. The purchased vouchers are valid for up to six months from the date of purchase, as the period will be indicated in the voucher itself. Within two weeks of purchasing the voucher, the client must book the specific service that is the subject of the voucher. The services mentioned in the voucher are subject to confirmation by the hotel on the specified telephone numbers and by e-mail: reservatons.hotel@midalidare.bg of Midalidare Hotel & SPA. If Midalidare Hotel & SPA is unable to confirm a reservation for the dates you want, it offers other alternative dates for the voucher period or extends the reservation period by 14 days.  If during the extended reservation period there is a repeated inability by Midalidare Hotel & SPA to confirm a reservation for the dates you want, it refunds the amount paid by you in 100%, within 14 working days.

3.2. In case the client wishes to extend the voucher period by another month, he owes an additional payment of 30% of the voucher’s value.

3.3. If the validity period specified in the voucher is exceeded, the voucher is considered invalid. If for objective reasons you cannot use your voucher within the normal stated period, please contact us within the two-week reservation period so that we can find the most suitable solution for you.

4. Payment

4.1. Each client can pay the price of the respective offer by choosing one of the relevant methods specified on the site:

·        Payment by credit/debit card on site;

5. Delivery

5.1. The voucher(s) for a given order will be delivered to you at the delivery address you have specified by a courier at your expense.

Please, if necessary, note preferred delivery times, specific features for access to your address, etc. at e-mail: reservations.hotel@midalidare.bg at Midalidare Hotel & SPA.

If, due to your fault, the courier cannot contact you for delivery and has to call you again, you will pay the full price of the delivery once again. If you have chosen the option to print the voucher(s) yourself, after receiving the payment, the option to print in your profile will be activated.

6. Return of a purchased service

6.1. According to Art. 55 of the Consumer Protection Act, you can return purchased vouchers for a given order within fourteen days from the date of delivery. Delivery costs, as well as fees for money transactions will be at your expense. We undertake to refund the amount of your purchase within 30 days to an account previously announced by you.

7. Personal data protection

7.1. According to the Personal Data Protection Act, we guarantee that we process your personal data in good faith and do not provide them to third parties.

7.2. The personal data you provide on the site - email address, phone number, name and delivery address - are necessary for the processing of your orders.

7.3. Providing an email address is mandatory so that we can automatically inform you about the status of the order.

7.4. Providing your bank account is mandatory so that we can refund the amount you paid if necessary.

7.5. Correspondence between the parties regarding the reservation of the service and its confirmation is carried out by email, for the purpose of authentication.
